1. Ownership and Intellectual Property
The Banking AI Controls Standard (BAICS), including but not limited to all frameworks, control statements, methodologies, processes, taxonomies, diagrams, narratives, mappings, updates, revisions, derivative concepts, and related materials (collectively, the "BAICS Materials"), is the exclusive intellectual property of the Financial Services AI Council, d/b/a Financial Services AI Holdings, LLC ("FSAIH").
All rights, title, and interest in and to the BAICS Materials are owned solely by FSAIH and are protected by applicable copyright, trademark, trade secret, and other intellectual property laws.
2. Trademarks
BAICS, Banking AI Controls Standard, Financial Services AI Council, and FSAIC are trademarks and/or registered trademarks of Financial Services AI Holdings, LLC.
Unauthorized use of these marks, including use in marketing, certification claims, comparative analyses, or product descriptions, is strictly prohibited.
3. Permitted Use – Reference and Commentary Only
BAICS is made available via https://www.baics.ai solely for non-commercial reference, review, and public commentary purposes.
Permitted use is limited to:
- Viewing and reviewing BAICS Materials for informational purposes only
- Submitting feedback or commentary through channels expressly authorized by FSAIH
No operational, production, or commercial use is permitted under this license.
4. Prohibited Uses
Unless expressly authorized in writing by FSAIH, you may not, directly or indirectly:
- Use BAICS or any portion thereof for commercial purposes
- Implement BAICS within organizational, operational, governance, compliance, audit, risk, or control environments
- Represent adoption, alignment, compliance, or certification with BAICS
- Offer consulting, advisory, assessment, certification, or tooling services based on BAICS
- Reproduce, distribute, publish, sublicense, sell, lease, or transfer BAICS Materials
- Create derivative works, summaries, adaptations, translations, mappings, or modified versions of BAICS
- Incorporate BAICS into software, AI systems, models, datasets, training materials, platforms, or services
- Use BAICS to develop competing or substitute frameworks, standards, or control systems
- Remove or alter proprietary notices, trademarks, or attribution
Any use beyond reference and commentary requires a separate commercial license agreement executed by FSAIH.
5. No License or Rights Granted
Nothing in these terms grants any license or right, whether express or implied, under any intellectual property right of FSAIH, including patents, copyrights, trademarks, or trade secrets.
All rights not expressly granted are expressly reserved.
6. Unauthorized Use and Enforcement
Any unauthorized use, reproduction, distribution, misrepresentation, or infringement of the BAICS Materials constitutes a violation of FSAIH's intellectual property rights and may result in:
- Immediate termination of access
- Injunctive or equitable relief
- Monetary damages
- Recovery of attorneys' fees and enforcement costs
- Civil and/or criminal prosecution to the maximum extent permitted by law
FSAIH actively monitors and enforces its rights.
7. No Warranty; No Reliance
BAICS is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or regulatory acceptance.
Publication of BAICS does not constitute endorsement, certification, regulatory approval, or validation of any organization, system, or product.
8. No Legal, Regulatory, or Professional Advice
BAICS does not constitute legal, regulatory, compliance, risk management, or professional advice. Organizations are solely responsible for determining applicable obligations and should consult qualified professionals before taking action.
9. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.
